From the above framework and context, ethnographies conducted in two educational establishments, during 2014-2018, will be analyzed. In them, it is possible to identify two relevant argumentative axes that account for the production of women as second-class subjects, accentuating the analysis in the crossing between the forms of economization of life in a neoliberal key, and the implications of this from a gender perspective. Communicating an unfavourable prognosis while maintaining patient hope represents a critical challenge for healthcare professionals. Duty requires respect for the right to patient autonomy while at the same time not doing harm by causing hopelessness and demoralisation. In some cases, the need for therapeutic privilege is discussed. The primary objectives of this study were to explore HPs’ perceptions of hope in the prognosis communication and investigate how they interpret and operationalise key ethical principles. Sixteen qualitative semistructured interviews with HPs from (...) different positions and experience, including doctors and nurses in four different departments, were conducted in the Ticino Cantonal Hospital, Switzerland. The interviews were recorded, transcribed verbatim and analysed using thematic analysis. HPs defined prognosis and patient hope as interdependent concepts related to future perspectives for subjective quality of life. Two main factors allow HPs to maximise the benefits and minimise the harm of their communication: respecting the patient’s timing and sharing the patient’s wishes. Time is required to reframe needs and expectations. Furthermore, communication needs to be shared by HPs, patients and their relatives to build common awareness and promote a person-centred approach to prognosis. In this process, interprofessional collaboration is key: doctors and nurses are complementary and can together guarantee that patients and relatives receive information in the most appropriate form when they need it. Organisational aspects and the HPs’ emotional difficulties, particularly in coping with their own despair, are barriers to effective communication that need further investigation. (shrink)

RESUMO A série Black Mirror, transmitida entre 2011 e 2023 pela Netflix, tornou-se um fenômeno de mídia e seus episódios mostraram formas de interação homem-máquina (terminologia também referida como humano-computador). O nome da série se refere ao fato de que, quando uma tela é desligada, ela se torna um espelho negro que reflete a imagem do usuário. Este artigo1 tem como objetivo analisar os efeitos da interação homem-máquina nas organizações produtivas apresentadas em Black Mirror. Esta pesquisa utilizou a análise do (...) discurso, principalmente a partir das contribuições de Mikhail Bakhtin. O método consistiu em três etapas que contaram com a colaboração de estudantes de graduação e pós-graduação em Engenharia de Produção, integrando ensino e pesquisa e desenvolvendo o senso crítico dos pesquisadores-iniciantes. Os resultados indicam que, nas organizações apresentadas na série Black Mirror, há uma transição do conceito de fatores humanos para fatores ciborgues, bem como o uso da interação homem-máquina para promover o controle social. What distinguishes evils from ordinary wrongs? Is hatred a necessarily evil? Are some evils unforgivable? Are there evils we should tolerate? What can make evils hard to recognize? Are evils inevitable? How can we best respond to and live with evils? Claudia Card offers a secular theory of evil that responds to these questions and more. Evils, according to her theory, have two fundamental components. One component is reasonably foreseeable intolerable harm -- harm that makes a life indecent and impossible (...) or that makes a death indecent. The other component is culpable wrongdoing. Atrocities, such as genocides, slavery, war rape, torture, and severe child abuse, are Card's paradigms because in them these key elements are writ large. Atrocities deserve more attention than secular philosophers have so far paid them. They are distinguished from ordinary wrongs not by the psychological states of evildoers but by the seriousness of the harm that is done. Evildoers need not be sadistic:they may simply be negligent or unscrupulous in pursuing their goals. Card's theory represents a compromise between classic utilitarian and stoic alternatives (including Kant's theory of radical evil). Utilitarians tend to reduce evils to their harms; Stoics tend to reduce evils to the wickedness of perpetrators: Card accepts neither reduction. She also responds to Nietzsche's challenges about the worth of the concept of evil, and she uses her theory to argue that evils are more important than merely unjust inequalities. She applies the theory in explorations of war rape and violence against intimates. She also takes up what Primo Levi called "the gray zone", where victims become complicit in perpetrating on others evils that threaten to engulf themselves. While most past accounts of evil have focused on perpetrators, Card begins instead from the position of the victims, but then considers more generally how to respond to -- and live with -- evils, as victims, as perpetrators, and as those who have become both. Examinaremos como surge, na Kritik der Urteilskraft, a discussão acerca do belo como símbolo do bem moral, a saber: na Dialética da faculdade de julgar estética, na segunda divisão da Crítica da faculdade de julgar estética. Traçaremos paralelo entre a antinomia do gosto e sua resolução com a antinomia da razão prática, tal como apresentada na Kritik der praktischen Vernunft. Pretendemos mostrar como ambas fazem recurso à distinção entre fenômenos e coisas em si como fonte de sua resolução. Discutiremos, em (...) seguida, como Kant apresenta a necessidade de sensibilização de ideias estéticas, e como o simbolismo permite tal feito. Além disso, vincularemos tais passos da argumentação de Kant à defesa do idealismo da finalidade. (shrink)

The article introduces the problematics of the classical two-valued logic on which Western thought is generally based, outlining that under the conditions of its logical assumptions the subject I is situated in a world that it cannot address. In this context, the article outlines a short history of cybernetics and the shift from first- to second-order cybernetics. The basic principles of Gordon Pask’s 1976 Conversation Theory are introduced. It is argued that this second-order theory grants agency to others through a (...) re-conception of living beings as You logically transcending the I. The key principles of Conversation Theory are set in relation to the poetic forms of discourse that played a key role in art as well as philosophical thinking in China in the past. Second-order thinking, the article argues, is essentially poetic. It foregoes prediction in favour of the potentiality of encountering tomorrow’s delights. (shrink)

Statements such as “X is beautiful but I don’t like how it looks” or “I like how X looks but it is not beautiful” sound contradictory. How contradictory they sound might however depend on the object X and on the aesthetic adjective being used (“beautiful”, “elegant”, “dynamic”, etc.). In our study, the first sentence was estimated to be more contradictory than the latter: If we describe something as beautiful, we often intend to evaluate its appearance, whereas it is less counterintuitive (...) to appreciate an appearance without finding it beautiful. Furthermore, statements including “beautiful” appeared more contradictory than those including “elegant” and “dynamic”, pointing to its greater evaluative component. When related to artworks, sentences could appear less contradictory due to readers’ consideration of the divergence between conventional beauty and art-related sensory pleasures that can even include negative valence. Such ambivalence might be more frequent in art-objects than in other artefacts. Indeed, in our study, sentences referring to artworks were estimated to be less contradictory compared to sentences referring to other artefacts. Meanwhile, an additional small group of graphic design students showed a less clear difference between art-related and non-art-related sentences. We discuss the potential influence of art experience and interest as well as theoretical and methodological challenges like the conceptualization of beauty. (shrink)

This is a comprehensive analysis of the idea of libertas and its conflicting uses in the political struggles of the late Roman Republic. By reconstructing Roman political thinking about liberty against the background of Classical and Hellenistic thought, it excavates two distinct intellectual traditions on the means allowing for the preservation and the loss of libertas. Considering the interplay of these traditions in the political debates of the first century BC, Dr Arena offers a significant reinterpretation of the political struggles (...) of the time as well as a radical reappraisal of the role played by the idea of liberty in the practice of politics. She argues that, as a result of its uses in rhetorical debates, libertas underwent a form of conceptual change at the end of the Republic and came to legitimise a new course of politics, which led progressively to the transformation of the whole political system. Both for standard users and for law scholars, it is often difficult to have an overall view on the existing alternatives, their main features and their interlinking with the other ontologies. To answer this need, in this paper, we address an analysis of the state-of-the-art in legal ontologies (...) and we characterise them along with some distinctive features. This paper aims to guide generic users and law experts in selecting the legal ontology that better fits their needs and in understanding its specificity so that proper extensions to the selected model could be investigated. Addressing studying as a distinct educational concept and phenomenon in its own right, the essays in this volume consider study and studying from a range of perspectives. Countering dominant educational discourses, which place a heavy emphasis on learning and instruction, the contributors explore questions such as: What does it mean to study something? How is studying something different from being taught about it, or learning something about it? What does the difficulty demanded by study mean for the one who studies (...) and for the teacher? This book presents a collection of chapters on the nature, flexibility and acquisition of lexical categories. These long-debated issues are looked at anew by exploring the hypothesis of lexical polycategoriality –according to which lexical forms are not fully, or univocally, specified for lexical category– in a wide number of unrelated languages, and within different theoretical and methodological perspectives. Twenty languages are thoroughly analyzed. Apart from French, Arabic and Hebrew, the volume includes mostly understudied languages, spoken in New Guinea, Australia, New (...) Caledonia, Amazonia, Meso- and North America. Resulting from a long-standing collaboration between leading international experts, this book brings under one cover new data analyses and results on word categories from the linguistic and acquisitional point of view. Several theories propose that one of the core functions of inner speech (IS) is to support subjects in the completion of cognitively effortful tasks, especially those involving executive functions (EF). In this paper we focus on two populations who notoriously encounter difficulties in performing EF tasks, namely, people diagnosed with schizophrenia who experience auditory verbal hallucinations (Sz-AVH) and people within the Autism Spectrum Conditions (ASC). We focus on these two populations because they represent two different ways in which IS can (...) fail to help in EF tasks, which can be illustrative for other mental conditions. First, we review the main components of EF (Section 1). Then we explain the functions that IS is taken to perform in the domain of EF (Section 2) and review the evidence concerning problems about EF in the two populations of our study: Sz-AVH (Section 3) and ASC (Section 4). After this we further detail our account about what a properly functioning IS can do for both populations and how different IS profiles may impact EF performance: in the case of Sz-AVH, the uncontrolled and intrusive character of IS negatively affects EF performance, whereas in ASC, EF is not sufficiently supported by IS, given the tendency in this population to present a diminished use of IS (Section 5). We finally briefly discuss Attention Deficit/Hyperactivity Disorder (ADHD) and Developmental Language Disorders (DLD). (shrink)

We examine whether a taxpayer’s decision to choose a taxpayer-favorable characterization of income is associated with contextual and individual dimensions of that decision. Using a 2 × 2 factorial experimental design, we manipulate the prevailing social norm on whether there is a general belief that a specific form of income should be characterized as a capital gain or as ordinary income, and the group affiliation on whether the individual is making a tax characterization decision as a sole proprietor or as (...) a member of a group practice. Moreover, we measure participants’ fairness perception of characterizing the income as capital gains versus ordinary. We study the decisions of 180 graduate business and accounting students from two US business schools to explore these dimensions using a tax-ambiguous income situation. Results indicate that both contextual and individual dimensions impact taxpayer decisions. Specifically, the social norm and fairness perception of characterizing income as capital gains affects the likelihood of choosing such a characterization. Being a sole proprietor or a member of a group practice does not have any significant main effect. However, relative to all other conditions, taxpayers are most likely to characterize income as capital gains when both the social norms are for capital gains characterization and when the taxpayer is a member of a group practice. Results remain largely robust to a variety of alternative explanations. We conclude the paper with a discussion of our findings and their implications for tax policy, enforcement, and research. The paper addresses the problem of imaginative resistance in science, that is, why and under what circumstances imagination sometimes resists certain scenarios. In the first part, the paper presents and discusses two accounts concerning the problem and relevant for the main thesis of this study. The first position is that of Gendler, The Architecture of the Imagination: New essays on pretence, possibility and fiction, Oxford University Press, New York, 2006a), The routledge companion to philosophy of literature, Routledge, New York, 2016), (...) according to which imaginative resistance mainly concerns evaluative scenarios, presenting deviant moral attitudes. The second account examined is that of Kim et al. Advances in experimental philosophy of aesthetics, Bloomsbury, London, 2018), who insisted on the link between imaginative resistance on the one hand and counterfactual and counterdescriptive scenarios on the other. In the light of both theories, this paper discusses the importance of addressing the problem of imaginative resistance in the scientific enterprise in the light of some mechanisms of embodied simulation, based on the activity of mirror neurons and investigated within the framework of the Embodied Simulation Theory. Clinical Ethics Consultation (CEC) has grown significantly in the last decade, and efforts are being made to professionalize the practice. The American Society for Bioethics and Humanities (ASBH) has been instrumental in this process, having published the _Code of Ethics and Professional Responsibilities for Healthcare Ethics Consultants_ and founded and endorsed the creation of the _Healthcare Ethics Consultant Certified (HCEC) Certification Commission._ The ASBH also published “core competencies” for healthcare ethics consultants and has delineated a clear identity and role of (...) such consultants distinct from that other healthcare professionals. In addition, more enter the field armed with advanced degrees (MA and PhD) or certification in clinical ethics consultation. While some have questioned the trend toward professionalization, the momentum is clearly in its favor. This paper explores three questions: Does the professionalization of healthcare ethics consultation expose those engaged in the field to the types of liability claims faced by professionals in other fields? What specific liabilities could affect a healthcare ethics consultant? And finally, what should healthcare ethics consultants do to protect themselves against liability claims? We conclude that while the risk of liability remains low, those engaged in the field should accept that risk just as part of their status as professionals and, like those in allied professions, seek appropriate protection in the form of liability insurance. Bortolotti argues that we cannot distinguish delusions from other irrational beliefs in virtue of their epistemic features alone. Although her arguments are convincing, her analysis leaves an important question unanswered: What makes delusions pathological? In this paper I set out to answer this question by arguing that the pathological character of delusions arises from an executive dysfunction in a subject’s ability to detect relevance in the environment. I further suggest that this dysfunction derives from an underlying emotional imbalance—one that leads (...) delusional subjects to regard some contextual elements as deeply puzzling or highly significant. A finalidade explícita na arquitetura e ênfase na utilidade, no aspecto de uma aplicação prática, intrigou filósofos alemães como Immanuel Kant e August Schlegel. O entrelaçamento entre beleza e finalidade na arquitetura fora notado cedo por Marco Vitrúvio Polião, que aponta utilidade, solidez e beleza como características fundamentais da obra arquitetônica. Segundo Guyer, a partir de Kant, o pensamento filosófico sobre a arquitetura começa a apresentar um distanciamento em relação a Vitrúvio, de modo que, mesmo sem total renúncia à tríade (...) vitruviana no pensamento de Kant, este defende ser a característica principal da arquitetura representar ideias estéticas. A tese de Guyer aponta o desenvolvimento desse ponto de Kant em Schelling, Hegel e Schopenhauer, todavia com uma lacuna: August Schlegel, fundador do primeiro sistema de belas artes com sua Kunstlehre. Buscaremos aprofundar como a tese de Guyer não só é válida, mas ganha mais solidez no caso de August Schlegel e do papel que este confere à imaginação na arquitetura. Após a indicação de elementos vitruvianos e pós-vitruvianos em Kant e Schlegel, indicaremos as divergências entre ambos na apreciação da arquitetura, a partir de suas articulações entre arquitetura e finalidade. A Crítica da faculdade de julgar foi recebida com entusiasmo pelos filósofos do idealismo alemão. No caso de Friedrich Schelling, as duas partes da obra foram influentes, de modo que não só a estética kantiana, mas também a teleologia foi marcante em sua trajetória filosófica. Observaremos como o filósofo de Leonberg acolhe, na Introdução às Ideias para uma filosofia da natureza, a noção kantiana de organismo como dotado de autocausalidade, mas pensa-a nos quadros de uma filosofia pós-kantiana, buscando prescindir das (...) noções de juízo reflexionante e também da ideia de “natureza como arte” para se pensar o organismo. Como Schelling vincula essa noção com a proposta de se pensar a unidade entre natureza e espírito a partir do próprio sujeito, e não de algo exterior a ele? Como Kant reagiria a tal proposta? The Critique of Judgment was enthusiastically received by the German Idealists. In the case of Friedrich Schelling, both divisions of the work were influent, thus resulting that not only Kantian aesthetics, but also the teleology was a landmark in his philosophical itinerary. We attempt to observe how the philosopher of Leonberg receives, in the Introduction to the Ideas for a Philosophy of Nature, the Kantian conception of organism as endowed with self-causality, but at the same time thinks it within the frame of a post-Kantian philosophy, leaving aside the reflective judgment and also the idea of nature as a product of art in order to think the organism. How does Schelling connect this notion with the proposal to think the unity between nature and spirit based on the own subject, and not on something external to it? How would Kant react to such a proposal? (shrink)

Buscar-se-á no presente trabalho analisar os discursos acerca da formação do Estado em Rousseau e Locke. Os autores compartilham a teoria de uma forma de contrato social – um acordo deliberado entre seres humanos cuja condição selvagem se extingue neste momento decisório. Dessa forma, em ambos os autores, o Estado surge como um agente, ou corpo, protetor. Em contrapartida, os estudos de Pierre Clastres – etnólogo francês – referentes a grupos primitivos contemporâneos demonstram a existência de uma permanente conjuração contra (...) a possibilidade do surgimento de um poder político alienado do controle do grupo como um todo. Ou seja, uma conjuração contra o Estado. Nesse sentido, o objetivo geral desse trabalho é colidir tais ideias, assim como suas possíveis reverberações atuais. (shrink)

Das ethische Prinzip des Respekts vor der Autonomie des Patienten/Probanden hat in der modernen Medizin mittlerweile weltweit Bedeutung erlangt. Die Betonung der Autonomie des Patienten und Probanden in allen in der letzten Zeit verabschiedeten internationalen Deklarationen gibt dieser Tendenz unmissverständlich Ausdruck. Doch wenngleich diese Entwicklung unstrittig positiv ist, wirft sie dennoch eine Reihe von Fragen auf, die mit der Kodifizierung, Interpretation, Reichweite und Anwendung dieses universalen Prinzips verbunden sind. Die Antworten auf diese Fragen entscheiden darüber, ob Autonomie als hilfreiches, emanzipatorisches (...) oder als überforderndes, gar hegemoniales Prinzip begriffen wird. Diese normativen Probleme werden anhand von Beispielen aus der globalen Medizinethik verdeutlicht. Was in modernen Gesellschaften als Autonomie bezeichnet und für die Praxis fruchtbar gemacht wird, ist als ein soziales Konstrukt zu verstehen, nicht im Sinne einer Schimäre, sondern im Sinne einer soziokulturellen Leistung, die auf komplexen, historisch gewachsenen und kulturell geprägten Interaktionen von Gesellschaften, Institutionen und Individuen beruht.
